1. New owner agrees to provide a clean, healthy and spacious, securely fenced, safe environment. This environment should include plenty of human companionship, regular exercise/play, a nutritionally sound diet, timely veterinarian care, proper deworming schedule and complete and up to date vaccination or above specified puppy.
2. Breeder reserves first right of refusal and right to repossess. Buyer agrees that if for any reason he/she cannot keep the dog in it’s lifetime that the buyer will return the puppy to the breeder who will gladly take the puppy/dog back. Buyer agrees that they will not be reimbursed for any portion of the purchase price of said dog. The new owner agrees to give said puppy best of care both physically and emotionally and will never sell or give puppy away to any pet shop, pet farm, puppy mills, or any other similar situation. If at any time the puppy is kept in an unsafe, unhealthy, abusive or neglectful environment, breeder has the right to repossess said pup/dog.
3. Breeder promise that, to the best of their knowledge, this puppy is in good health at the time of sale. Our puppies have had age appropriate shots and deworming. Validation of this Health Guarantee requires examination of your puppy by the vet of buyers choice and at buyers expense within two business days of the pick up or delivery date. If breeder does not not receive proof of examination within two business days of receipt of puppy, this contract becomes null and void. If the veterinarian determines this puppy unfit for sale due to health-related problems the buyers must notify breeder within 24 hours of initial exam.
4. If at time of initial puppy exam (within 2 business days sale) the puppy is found to have a major untreatable health defect or illness, the puppy may be returned (at buyers expense), for full refund can be given or the purchase price of the puppy, excluding any shipping fees. In order for replacement or refund buyer must contact seller within 24 hours and immediately send veterinarian report to Sellers Veterinarian to review. Once refund is approved by Seller puppy must be returned within 24 hours along with vet letter/roof of examination and findings, all documents pertaining to puppy including, but not limited to: registration, guarantee, contract and shot record.
5. At no time will the breeder be responsible for any vet bill incurred (for any reason) after puppy leaves breeders premises.
6. This Health Guarantee does not cover – internal or external parasites of any kind, such as fleas, mites, ticks, ringworm, giardia, coccidia (as both are proven to lie dormant and are brought on by external conditions such as stress,etc). New owner agrees to get regular exams done on puppy to avoid high levels of infestation. Also not covered are hernias of any kind, any trachea problems, open fonts, kennel cough, reverse sneezing, loose stool, immunity level, ear infection undescended testicles, of bite(any dental problems), any injuries incurred after the puppy left the breeders care, allergies, bordetella, heat exhaustion, travel induced condition, or hypoglycemia (which is preventable with good care and feeding).
7. The Health Guarantee against transmissible diseases such as parvovirus, for example, is valid for a period of 7 days starting on the day of delivery, since the normal incubation period or transmissible diseases is 3 to 7 days. For example, if first sight of diseases, such as, parvovirus were to show on a puppy 12 or 15 days from delivery, the puppy could not have carried the disease from the breeders premises and incubated it for that long before showing signs of he disease.
8. Breeder warrants the puppy until one year of age against all life threatening congenital or hereditary defects, untreatable conditions only. If puppy is found to have one of these conditions or dies from one of these conditions, the buyer’s veterinarian must perform exam and/or autopsy, finding must be reported to seller’s veterinarian for review before 1 year is up. If it is determined that the puppy has a life threatening congenital or hereditary defect which is not possible to treat, then the breeder will replace puppy, as soon as possible, with a puppy of equal value, as soon as the above conditions are met. This agreement/warranty is valid only until the puppy turns 1 years of age. Breeder is not responsible for any puppy death due to hypoglycemia, dehydration, internal or external parasite/bacteria/viruses or any other illness that could have been prevented by the new owner.
9. Yorkshire Terriers can dramatically change their color, size, weight and appearance as they grow and mature. Breeder can give an approximation as to the size and color puppy is going to be when full grown, but breeder gives no guarantee regarding size, weight or color of said puppy. There is NO guarantee, written or implied, as to adult size of puppy, show potential, ear size or positioning, coat quality or temperament. This puppy is being sold as pet quality only, even when breeding rights are given. There is no guarantee against breeding soundness, sperm count/quality, females coming into heat, or reproducing. Joyful Traditional Yorkie strives to improve the quality of the breed and endeavors to produce healthy, hearty puppies, however, there is no guarantee against luxating patella due to the many factors and causes of said conditions. i.e. an injury or improper care.
10. The Health Guarantee made in this contract apply to the original pup and original owner only and are not transferable to a third party.
11.This contract contains the entire agreement between the parties and no statement, promises, or inducements made by either party that are not contained in the written contract shall be valid or binding. Tis contract may not be modified or altered. By purchasing your puppy, the buyer, agree that you have read, understand, and accept the terms of this contract.
